What Is The Correct Overtime Pay You Should Be Making?

Overtime wages are meant for employees who work more than 40 hours a week, over 8 hours per workday and outside of 6 consecutive workdays within a week. The law in California for overtime states that employers are required to pay their employees one and one-half times their regular rate for every hour worked in excess of a regular 8 hour shift and up to and including 12 hours in any workday. They also have to double an employee’s regular rate of pay for all hours worked in excess of 12 hours in any workday and for all hours worked in excess of 8 hours on the seventh consecutive day of work in a workweek. California’s overtime law also protects undocumented workers, so employees can get the help they deserve without fear of deportation.

Not every employee is eligible for overtime pay; there are some exemptions to California’s overtime law in regards to which classification of employees should be paid this way, but most employees will, particularly if you are paid hourly.

Reasons Why Employer May Unjustly Deny Overtime Pay

  • Employee is paid on a salary basis, leading employers to believe they are exempt from being eligible to receive overtime wages (however, some salaried positions are supposed to be paid overtime!)
  • Phony titles for positions like “manager,” lead employees to believe they’re ineligible for overtime pay due to the higher status of their title (when really, they are doing the work of a normal employee and deserve to be paid overtime)
  • Giving comp time, which can be used to leave work early or attend an appointment but isn’t actually paid time,
  • And more!
