What Is The Correct Overtime Pay You Should Be Making?

According to the state of California, overtime wages should be one and one-half times the employee’s regular rate and are meant for employees who:

  • Work more than 40 hours a week
  • Work over 8 hours and up to 12 hours per workday
  • Work outside of 6 consecutive workdays within a week.

Employers are also required to pay double an employee’s standard rate when an employee works an excess of 12 hours on any workday, and for all hours worked in excess of 8 hours on the seventh consecutive day of work in a workweek.

There are exemptions to California’s overtime law in regards to which classification of employees are eligible for overtime wages, but on the whole, particularly if you are an hourly worker, you likely should be getting paid for overtime you work.

Reasons Why Employer May Unjustly Deny Overtime Pay

There are many reasons why an employer might deny overtime pay. Some of the reasons include, but are not limited to, the following:

  • Lack of knowledge

An employer is unaware that their employee is entitled to overtime pay for working above 40 hours. This is an innocent reason, but employers should know these things in order to run legally compliant businesses, and it still hurts you financially even if that was not their intention.

  • Employee is paid on a salary basis

Some employers believe (or maintain) that salaried employees are automatically exempt from being eligible to receive overtime wages. While some are exempt, not all are, and it is an excuse many employers may attempt to hide behind.

  • Phony titles

Under the Fair Labor Standards Act, management positions aren’t entitled to overtime pay. Therefore, some companies will use a phony title for an employee who does not perform the work of a manager or supervisor to get out of having to pay that employee for overtime.

  • And more!

Why You Should Choose Us

Not being paid overtime has serious consequences for you and your family, not the least of which is that it is simply unjust – you are being cheated out of money that you have rightfully and legally earned! That could amount to thousands of dollars per year, depending on your specific situation, which is money that you could have used for savings or to seize financial opportunities for yourself and your loved ones. If your employer is breaking overtime rules, it is likely that they may also be breaking other rules and withholding additional pay from you. You deserve to be paid fairly and even paid additional damages to make up for the financial losses you suffered.

However, employers hold a lot of power, which is why you need our San Diego overtime wage lawyers on your side! We will listen to your story, investigate your case, gather evidence, explain your rights and options, communicate and negotiate with your employer for maximum compensation, and even advocate for you in court if necessary. Here are some of the reasons why employees choose our firm to represent them:

  • 60+ years of combined experience
  • Multilingual attorneys
  • Ranked in the top 10% of California law firms
  • We can protect undocumented immigrant workers who have been wronged by employers from immigration consequences – you don’t have to fear deportation!
