What Is The Correct Overtime Pay You Should Be Making?

In California, the overtime wage law states that general overtime wages are to be paid to all non-exempt employees 18 years of age or older that work the following:

  • More than eight hours in any workday
  • More than 40 hours in any workweek

If an employee is working these hours, they are entitled to one and one-half times their normal rate of pay. The law also states that if an employee were to work more than 12 hours in a single workday or more than 8 hours for 7 consecutive workdays, that he or she should receive double their standard rate.

Reasons Why Employers May Unjustly Deny Overtime Pay

There aren’t any valid reasons for your employer to not be paying you overtime if you fall under the above mentioned category, but here are some of the common excuses given:

  • Employer is “unaware” of your eligibility for overtime wages (even though it is their legal responsibility to know the law and abide by it)
  • Employer requires “off-the-clock work”( meaning you’ve already clocked out and you’re asked to continue working. This also applies to working on an unpaid lunch break.)
  • Employer gives you a phony management title to suggest a higher-level of employment (which exempts you from receiving overtime pay).
  • Comp time is given, which can be used to leave work early or go to an appointment, but that doesn’t provide additional pay.
