What Is The Correct Overtime Pay You Should Be Making?

In California, the overtime wage law states that general overtime wages are for a non-exempt employee 18 years of age or older. This employee is not to work more than eight hours in any workday or more than 40 hours in any workweek unless he or she receives one and one-half times his or her regular rate of pay for all hours worked over eight hours in any workday and over 40 hours in the workweek. It also states that if an employee were to work more than 12 hours in a single workday or more than 8 hours for 7 consecutive workdays, that he or she should receive double their standard rate.

There are exemptions to California’s overtime law in regards to which classification of employees are eligible for overtime wages – not every employee should be getting overtime pay, but many should!

Examples Of Being Denied Overtime Pay

  • Employer is “unaware” that you were eligible for overtime (even though they have a legal responsibility to know the law and abide by it!)
  • Employer insists you clock out and then continue to work or complete tasks, and doesn’t pay you for that time
  • Employer requires you to work during an unpaid lunch break
  • Employer gives you a phony management title to suggest a higher-level of employment which exempts you from receiving overtime pay
  • Comp time is given, which can be used to leave work early or go to an appointment but doesn’t provide additional pay
