Overtime Wage Attorney In Thousand Oaks, California

Depending on the job you have, you may be eligible to receive overtime wages when you work above a standard 40 hour work week. Unfortunately, in the state of California and across the nation, employers knowingly and unknowingly withhold overtime pay from deserving employees. This is illegal and unjust. Labor doesn’t come free, especially extra hours that aren’t necessarily required of your job title. If you feel that your employer might be cheating you out of your rightful overtime pay, our Thousand Oaks overtime wage lawyers at Southern California Attorneys A.P.C. can defend your rights under the law to help you obtain the compensation that you deserve.

What Is The Correct Overtime Pay You Should Be Making?

California’s law for overtime pay states that any non-exempt employee 18 years of age or older should receive one and one-half times their standard rate of pay for every hour of overtime they work. That includes hours above the 8 hour workday, and 40 hour workweek. The law also states that if an employee works above 12 hours in a workday or 8 hours a day for more than 6 consecutive workdays, they are entitled to double their standard rate per hour of overtime.

There are exemptions to this law in regard to which types of workers are eligible for overtime pay, but the majority of employees should be getting paid for overtime work.

Reasons Why Employer May Unjustly Deny Overtime Pay

There are many reasons why an employer might deny you your deserved overtime pay. Some of which include but are not limited to:

  • Faulty titles your employer gives you to insinuate you have a higher-level position or status within the company, which exempts you from being eligible to receive overtime pay.
  • Salary pay, which exempts many employees from being eligible to receive overtime wages, but not every position is this way.
  • Lack of knowledge, meaning the employer is unaware that their employee is entitled to overtime pay for working above 40 hours. While in some instances, this is innocent, employers should know these things in order to run legally compliant businesses. It also still hurts you financially even if that was not their intention.
  • And more!

None of these excuses exempt your employer from liability. They can and should still be held accountable for the financial losses you have suffered!
