Overtime Wage Attorney In Ventura, California

When you go into work, you do so with the understanding that you’ll be paid for your 8 hours a day, 40 hours a week. Sometimes, depending on your job, you may be required to work more than the standard 40 hours. If this is the case, your employer should be paying you the correct overtime wage required by California state law. Unfortunately, many employers do not do their due diligence on ensuring they are informed of California labor laws and often withhold overtime wages (either unknowingly or knowingly) from their employees. This is illegal and unfair to you. If you believe your manager, director, owner or other form of employer is withholding wages from you, our Ventura overtime wage lawyers can help protect your rights under the law and secure the pay that is rightfully yours! Call today to schedule a free consultation and learn more.

What Is The Correct Overtime Pay You Should Be Making?

According to the state of California, all employees 18 years or older should receive one and one-half times their standard rate of pay for every hour they work over 8 hours a day, and 40 hours a week. Also, if they were to work more than 12 hours in a single workday, or 8 hours for 7 consecutive workdays, they are entitled to double their standard rate of pay.

There are exemptions to California’s overtime law in regards to which classification of employees are eligible for overtime wages, but the majority of hourly workers likely should be getting paid for overtime work.

Reasons Why Employer May Unjustly Deny Overtime Pay

Employee works on salary

For many salary positions, employees are ineligible to receive overtime pay. However, there are salary positions that do require overtime wages, so it is important for employees to ensure they know what exemptions apply to them.

Lack of knowledge

An employer is unaware that their employee is entitled to overtime pay for working above standard work week hours (40). While some genuinely are unaware, many employers will play dumb to avoid having to pay employees fairly. Legally, however, they are required to know these things in order to run their businesses; ignorance does not excuse unfair pay.

Comp time

Compensatory time is a term that refers to an arrangement to which an employee can take time off rather than receiving overtime pay. This is convenient for employers as they aren’t paying you any differently, but unfair to you because it offers no financial advantage.
